ShortforSale provides a variety services and information, including real estate listings, advertising, email services and links to third party sites (referred to hereafter as "the Service" or “our Service”). Our Service is available through the URL www.shortforsale.com (the "Site" or “our Site”). By visiting ShortforSale or using our Services you agree to be bound by the terms of use set forth on this page. NO FURTHER ACTION IS REQUIRED ON YOUR BEHALF. If you rather not be bound by these terms simply exit ShortForSale.com, and do not use the services on this website.

Registration

You may browse the Site for free and without registering. However, you must (a)register as an Agent to post listings on the Site, (b) register as a home buyer to register for a rewards program. During registration you may be asked to create an account using a Login ID and Password. This information will be used by you to enter your account in future visits. You may also be asked to provide personal information such as your name, address, telephone number, email, city, state and zip code. Any and all information that you provide when registering is collected according to the terms in our Privacy Policy You are responsible for maintaining the confidentiality of your username and password, and all uses of your account. You are responsible for and accept responsibility for all activities that occur under your account. You agree to notify ShortforSale immediately if there is suspicion of unauthorized use of your account. Should you decide to discontinue service please inform ShortforSale to delete your account. You may not transfer your account.

IMPORTANT: If you provide any information that is false, misleading, incorrect, or incomplete when registering or otherwise, ShortforSale may permanently delete your account thereby restricting and eliminating your present and future use of the Site and any Services. ShortforSale has the right to permanently delete your account without notice. If your account has been deleted please contact us for details.

You understand that all listings, messages, text, files, images, photos, video, audio or other materials ("Content") posted on, transmitted through, or linked from the Site are the sole responsibility of the person or organization from whom such Content originated. You also understand that although ShortforSale attempts to maintain accurate Content on the site, it is not responsible for information made available through the Site. You agree that by using the Site, you may be exposed to content that is inaccurate, incomplete, out of date, or false. You agree that ShortforSale has no liability for any misrepresentation, incomplete, false, or inaccurate information posted on the Site.

ShortforSale is not a broker and provides only a service and is not involved in any transaction between home buyers, sellers, and Agents. ShortforSale does not guarantee the ability or intent of users to fulfill their obligations. You are solely responsible for assessing for evaluating the accuracy of any listing posted on the Site.

Furthermore, Content made available through the Site may contain links to other web sites. ShortforSale makes no representation or warranty as the accuracy, or authenticity of the information contained on other web sites even if they are accessed through a link on ShortforSale. Under no circumstances will ShortforSale be liable in any way for any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, linked or otherwise made available on our Site. You understand and agree that any uploading or posting will be at your sole risk and ShortforSale shall not be responsible to you in any way even when you have granted ShortforSale permission to post for you. Furthermore, ShortforSale may use third-party software to provide its services, however it does not provide any warranty as to your use of third-party software on our Site. You are also fully responsible for any Content you post on the Site and you represent and warrant that you have the right to post this Content. Fees

We reserve the right to add, change, suspend or discontinue any fees for our Services at any time without prior notice, although prior notice may be provided as a courtesy to all users. Any and all fees are valid immediately after posted on the Site.

ShortforSale logos, icons and other marks identifying ShortforSale services or products are trademarks of ShortforSale and may not be used without prior written permission. You may make a single copy of individual screens on ShortForSale.com, and print a copy FOR PERSONAL USE ONLY. No reproduction, distribution, or transmission of material on ShortForSale.com is permitted without written permission by ShortForSale.

Limitations & Termination of Service

 You acknowledge that ShortforSale may limit your use of the Service. You agree that ShortforSale has no responsibility or liability for the deletion or failure to store any Content maintained or transmitted by the Service. You acknowledge that ShortforSale reserves the right to modify or discontinue part or all the Service at any time, with or without notice. For this reason ShortforSale shall not be liable to you or to any third party for any modification, temporary suspension or discontinuance of the Service.

Without limiting other remedies, we may limit or terminate your activity and immediately remove your listings, and indefinitely suspend or terminate your account and refuse to provide our Services to you if you breach this Agreement or any guidelines or rules pertaining to any and all services. In addition we may also terminate your account and refuse services if we are unable to verify any information you provide to us; or we believe that you have acted in a way that may cause financial loss or legal liability for you, our users or ShortforSale.

Privacy & Information Disclosure

ShortforSale may collect personal information in order to satisfy its services. ShortforSale is the sole owner of the information collected on the Site. We will not rent, sell or share your personal information with anyone unless you have ask us to do by doing requesting specific Services which require the transfer of your information including but not limited to: registering for our rewards program, or contacting a listing agent..

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF WARRANTIES OR OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE FOREGOING ABOVE MAY NOT APPLY TO YOU.

INDEMNITY

 YOU AGREE TO DEFEND, INDEMNIFY AND HOLD SHORTFORSALE AND ITS OFFICERS, EMPLOYEES, AND AGENTS, HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS MADE BY OR LIABILITIES TO ANY THIRD PARTY RESULTING FROM ANY ACTIVITIES CONDUCTED ON OUR SITE, YOUR USE OR MISUSE OF THE SITE OR OUR SERVICES, INCLUDING, BUT NOT LIMITED TO, POSTING CONTENT ON THE SITE, AND CONTACTING LISTING AGENTS AS A RESULT OF THEIR POSTING(S).
